Eligibility / qualifications
Bids may be rejected if they show any alteration of form, additions not called for, conditional or alternate cost proposals, incomplete cost proposals, irregularities of any kind, or if they contain a clause in which the vendor reserves the right to accept or reject a contract awarded to him. Bids in which the prices are obviously unbalanced or are otherwise regular which are not accompanied by satisfactory requirements will be rejected. Purchases by the City of Bismarck are not subject to the North Dakota State Sales Tax. Successful full-scale testing per the Trial Procedures and Specifications Section is required to be complete prior to cost proposal submission. The award shall be based on price and performance of the specified polymer(s) or approved equal polymers (lowest overall polymer cost per dry ton of biosolids produced based on the price per pound of polymer and the tested polymer consumption). The highest solids capture rate, highest cake solids, and lowest filtrate solids obtained during the plant trials by the City will be considered as part of the overall analysis and award, in addition to the provisions outlined in this request. Any accepted bid because of this solicitation is not exclusive. The City reserves the right to test competitive products at any time to allow the City to remain current with polymer technology and perform background work with other products. The unit price bid shall reflect the total cost of the delivered chemical to the Bismarck Wastewater Treatment Facility or other specified location. No additional charges or surcharges will be allowed during the life of the agreement. A good faith effort has been made to provide estimated quantities, however, the City does not guarantee a specific quantity of polymer that will be purchased.
